Terms of Use Agreement

Welcome to MortgageInfoCanada.ca website. Prior to using our website, please take a few minutes to review and familiarize yourself with “The Terms of Use Agreement” which governs the use of this site and describes the terms and conditions applicable to your use of MortgageInfoCanada.ca website.  In this document we may be referred to as “MIC,” “we,” “us,” or “our”, and collectively describe all of our products and services as “Services,” and Terms Of Use Agreement as “Agreement”.  MIC reserves the right to update, modify, or change the services and/or the Terms of Use Agreement from time to time at its own discression, and without notice to you.                                                                                                                                                                      
You must read, fully understand and agree with all terms and conditions contained in this Agreement, as well as our Privacy Policy before you use and access our Services.  If for any reason you do not agree with the terms and conditions contained herein, you may not access or use the Service. 

MIC Products and Services.   The MIC is an internet service that allows you to research, compare and get mortgage quotes for mortgage products offered by, but not limited to the number of banks, trust companies, credit unions, mortgage brokers, and other financial institutions and intermediaries dealing in mortgages, referred to in this Agreement as “Business Partners”. You agree and fully understand that should you choose to engage our Services, MIC will share with our Business Partners your personal data such as, but not limited to your full name, date of birth, social insurance number, addresses, employment, financial, property, and any other information supplied by you and entered into our system,  relating to the particular inquiry or mortgage transaction. You further agree and authorize MIC and its Business Partners to use your personal data to perform all necessary tasks in order to accommodate your credit request. Those tasks will include but not be limited to accessing your credit bureau, performing standard underwriting and due diligence functions normally performed during the credit granting and approval process.  You fully understand and acknowledge that MIC is NOT a credit granting institution, and is in no way involved in the underwriting process performed by our Business Partners, and that the Business Partners are solely responsible for their services to you. You also acknowledge that MIC is NOT acting as your advisor of any kind, broker, or agent, and is NOT recommending any particular mortgage product or Business Partner to you.  You understand and acknowledge that the requirements and underwriting criteria and processes for a particular mortgage product are solely set by individual Business Partners, and that MIC does NOT guarantee, warrant or endorse any of the products offered by any of the Business Partners.  Nothing contained in MIC website represents an offer, mortgage approval or commitment, and does NOT guarantee mortgage rate.  You agree that MIC shall NOT be responsible or liable for any costs or damages resulting from, or in connection with the use of any particular Business Partners services, or any particular Business Partners errors, omissions, neglect or wrongdoing of any kind, whether intentional or unintentional.  MIC may receive compensation from its Business Partners for the products and services rendered, which may include providing mortgage leads and/or selling advertising space on our website. MIC does not charge you for the use of our Service. In most cases each mortgage lead will be passed on to one Business Partner only, but in no instance to more than two Business Partners.   By submitting your request for a mortgage quote and/or mortgage financing you are consenting to be contacted by one of our Business Partners which may include but not limited to banks, trust companies, credit unions, mortgage brokers, and other financial institutions dealing in mortgages, either by phone, e-mail, or regular mail, based on the information you have provided.  This permission will override any previous contact restrictions you may have imposed on MIC or the Business Partners. In addition, MIC and the Business Partners may retain the information you have submitted whether or not you use their services.  You also authorize MIC to contact you from time to time, whether it be by phone, e-mail, or regular mail to provide you with information, services or products that may of interest to you.  If you no longer wish to receive communication from MIC and/or the Business Partners you must contact them individually through e-mail or regular mail. Your information will be erased immediately from MIC database.

Conditions Of Use.  You, hereby, certify to MIC that: (i) you are at least 18 years of age; (ii) all information you submit to MIC is truthful, accurate, and complete, and that under any circumstance knowingly or unknowingly you must NOT submit false, misleading, or inaccurate information; (iii) you assume full responsibility for the use on the Service by any minors in your household; (iv) your use of the service is in accordance with all applicable federal, provincial and municipal laws; (v) you must not transmit content that is illegal, offensive, harmful, vulgar, sexually explicit, abusive, or objectionable in reasonable person’s view; (vi) you must not attempt to interfere in any way, or compromise the integrity, and normal functioning or the system; (vii) you must not attempt to upload viruses, worms, false or invalid data, spy ware, and other harmful software to our system; (viii) you must not submit  false or persons’ identities, or in any other way impersonate another parson or entity; (ix) you must not under any circumstances release, sell, grant access to any materials and information contained in MIC website for gainful or commercial purposes and disclose it to third parties; (x) you must not use any automated software to gain access to the service; (xi) you must not attempt to breach or bypass any security measures we may employ to safeguard, prevent or restrict access to the Service.

Copyright, Trademarks and Proprietary Rights.  All contents, information, and imagery of the MIC Website are the property of MIC, with the exception of imagery, logos, and product names of the Business Partners, and Affiliates. Copyright 2007 MortgageInfoCanada.ca. All rights reserved.  You are prohibited to use or distribute MIC materials without MIC prior permission. You further acknowledge that the Service contains proprietary and confidential information, software, and materials which are the intellectual property of MIC, and under no circumstances may be copied, reproduced, modified in whole or in part.

Other Links and site re-directions.  MIC may provide links to other sites, which in most cases represent sites of our Business Partners, and/or are in intended for informational purposes only to compliment our Service and to educate the user about mortgages and mortgage related topics.  You acknowledge that MIC has no control over such websites and does not endorse products and services offered through these websites.   MIC shall not be liable or responsible neither directly nor indirectly for any losses, damages resulting from the use of such websites and/or product and services available through such websites.   

No Warranty.  MIC provides the Service “As Is”. We make no recommendations, representations, guarantees, warranties, or conditions expressed or implied in connection with using the Services.  The responsibility to independently research the market, market participants and other products, services, or to seek legal advice rests solely with the user.

Release.  You hereby irrevocably agree to release, remise, indemnify, and forever discharge MIC, its Business Partners, Affiliates, Contractors, and Service Providers and each of their directors, officers, shareholders, agents, employees, and all other related persons or entities from any and all liabilities, claims, obligations, damages, complaints, proceedings, costs, legal fees, and other claims of any nature, which may arise or relate to the use of this Service.
All parties acknowledge and agree that this agreement has been entered into in the province of Ontario, Canada. Any legal action, arbitration, or proceedings relating to this agreement must take place in the province of Ontario.
